Digital Millennium Copyright Act (DMCA) Policy

Introduction

Famablog respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (“DMCA”). This DMCA Policy outlines the procedures we follow when receiving notifications of alleged copyright infringement and our actions in response to such notifications.

Reporting Copyright Infringement

If you believe that material available on or through our website infringes upon any copyright you own or control, you may submit a notification of claimed infringement (“DMCA Notice”) to our designated copyright agent. Your DMCA Notice must include the following information:

  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature.

Counter-Notification

If you believe that material you posted on our website was removed or access to it was disabled by mistake or misidentification, you may submit a counter-notification to our designated copyright agent. Your counter-notification must include the following information:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you reside outside the United States, that you consent to jurisdiction of any judicial district in which we may be found), and that you will accept service of process from the person who provided notification under the DMCA or an agent of such person.
  4. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we may reinstate the removed material or cease disabling access to it, unless we receive notice from the original notifying party that they have filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on our website.

Repeat Infringers

It is our policy to terminate the accounts of repeat infringers in appropriate circumstances.

Changes to this DMCA Policy

We reserve the right to update or change this DMCA Policy at any time. Any changes will be posted on this page with an updated effective date.
