Copyright Infringement Notification

If you believe content on our website infringes on your copyright, please submit a written notification containing the following information:

  1. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works
  2. Identification of the allegedly infringing material with sufficient information to locate it on our website (e.g., URL, page title, article name)
  3. Your contact information including your legal name, address, telephone number, and email address
  4. A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  5. A statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner
  6. Your physical or electronic signature

Our Response Process

Upon receiving a valid DMCA notice, we will:

  1. Acknowledge receipt of your notification within 2-3 business days
  2. Review the claim to ensure it meets all requirements under the DMCA
  3. Remove or disable access to the allegedly infringing material
  4. Notify the affected user about the takedown and provide them with a copy of your DMCA notice
  5. Document the takedown in our internal records system

Counter-Notification Procedure

If you believe your content was removed due to mistake or misidentification, you may submit a counter-notification containing:

  1. Identification of the removed material and its previous location
  2. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  3. Your name, address, and telephone number
  4. A statement of consent to jurisdiction in the federal district court where your address is located (or if outside the US, any judicial district where Fama may be found)
  5. A statement that you will accept service of process from the party who submitted the original DMCA notice
  6. Your physical or electronic signature

What Happens After a Counter-Notification

Upon receipt of a valid counter-notification:

  1. We will provide a copy of the counter-notification to the original complainant
  2. We will inform the original complainant that we will restore the removed content within 10-14 business days
  3. We will restore the content after 10-14 business days unless we receive notice that the original complainant has filed legal action

Repeat Infringer Policy

We maintain a policy to terminate account privileges of users who repeatedly infringe copyright:

  • A user who receives three DMCA strikes within a 12-month period may have their account terminated at our discretion
  • A DMCA strike is recorded when we receive a valid DMCA notice and remove content accordingly
  • Strikes may be appealed through the counter-notification process
  • Terminated accounts will not be reinstated except in extraordinary circumstances

This policy is consistent with the DMCA’s requirement that service providers adopt and implement a policy for terminating repeat infringers in appropriate circumstances.
